Europe’s Critical Minerals Strategy Collides With Local Consent and Social Licence Risks

Europe’s accelerating drive to secure critical raw materials for its energy transition is now moving beyond policy design and into a far more complex reality: local consent, land use conflict, water stress, and the distribution of economic benefits in producing regions. While the European Union’s Critical Raw Materials Act (CRMA) has created one of the world’s most ambitious supply-security frameworks, growing scrutiny suggests it has yet to fully resolve the social licence challenges that determine whether mining and processing projects can actually be built.

At the heart of the EU strategy is a clear geopolitical objective. Lithium, nickel, copper, cobalt, graphite, manganese and rare earth elements are now treated as strategic inputs for Europe’s industrial future—essential not only for electric vehicles and batteries, but also for defence systems, grid infrastructure and advanced manufacturing. The bloc aims to reduce dependency on concentrated supply chains, particularly where processing and refining capacity is dominated by China or a limited number of external suppliers.

To achieve this, the CRMA sets binding 2030 targets: at least 10% domestic extraction, 40% EU-based processing, and 25% recycling, while ensuring no single third country supplies more than 65% of any strategic raw material at any stage of the value chain.

Strategic projects expand—but controversy follows

In 2025, the European Commission designated 60 CRMA strategic projects—47 inside the EU and 13 outside it—covering mining, processing, recycling, and substitution. These are designed to accelerate permitting, unlock financing, and strengthen Europe’s industrial resilience after recent supply-chain shocks. A new assessment by the Business & Human Rights Resource Centre highlights a deeper tension: what is “strategic” in Brussels is not always viewed as legitimate on the ground.

The analysis focuses on the 13 non-EU strategic projects across jurisdictions including Serbia, Brazil, Zambia, Madagascar, Malawi, Kazakhstan, South Africa, Ukraine, Canada, Norway, Greenland, New Caledonia and the UK. While they vary widely, they share a common issue: EU strategic status improves visibility and financing prospects before social and environmental risks are fully resolved.

Transparency and due diligence gap

A key concern is uneven disclosure standards. The report notes that none of the non-EU strategic projects currently publish both a full human rights policy (including protection for human rights defenders) and a comprehensive environmental and social impact assessment for the specific project. Only a limited number of companies, including Rio Tinto and Eramet, are linked to publicly available human rights policies. Even fewer are aligned with recognised responsible mining standards.

The concern is that CRMA designation can act as a form of soft de-risking, improving access to capital and political support before community consultation and environmental scrutiny are complete.

Social licence becomes a core investment risk

The CRMA requires that strategic projects meet sustainability criteria, including environmental protection, human rights respect, and community engagement. But critics argue that selection criteria and evaluation methods remain insufficiently transparent.

This matters because mining is not just a technical process—it is a long-term industrial investment. Even high-quality geological assets can fail if they face legal challenges, protests, or permitting delays driven by weak social acceptance. Increasingly, it is not only ore grades and reserves that determine success, but also governance quality and social stability.

Case studies highlight rising conflict risk

Several projects illustrate the growing friction between critical minerals demand and local realities. In Serbia, the Jadar lithium project, developed by Rio Tinto, has become a major flashpoint over concerns including water use, land disruption, environmental transparency and governance. Despite being framed as a key European lithium source, the project remains stalled amid sustained public opposition.

In Norway, the Nussir copper project faces resistance linked to Indigenous Sámi livelihoods, fisheries, and planned submarine tailings disposal. Earlier commercial relationships were affected, showing how ESG disputes can impact offtake agreements and downstream buyers.

In Madagascar and Malawi, graphite and rare earth projects face challenges tied to water scarcity, drought exposure, poverty and consultation capacity, highlighting how environmental and social conditions can amplify project risk. In South Africa, manganese and rare earth developments highlight both opportunity and tension: job creation potential versus water access, land use disputes and benefit-sharing expectations.

Value addition and development imbalance

A further structural issue is limited downstream processing. Of the 13 non-EU strategic projects, only four include significant processing capacity, while most remain focused on extraction. This raises a key development question: will producing countries capture more industrial value and skills, or remain primarily exporters of raw or semi-processed materials into European supply chains? Without local processing, countries bear the environmental burden of mining while capturing a smaller share of long-term value.

For investors, these issues translate directly into financial risk. Weak human rights due diligence, incomplete environmental assessments, or disputed consultation processes increase the likelihood of litigation, permitting delays, financing friction and offtake disruption. These risks feed into valuation, cost of capital, insurance pricing and equity dilution. In modern mining finance, a strong resource is no longer sufficient—social licence is part of bankability.

The CRMA is a major step forward in Europe’s critical minerals strategy, combining permitting reform, financing support and strategic designation. But its success now depends on whether it can incorporate stronger accountability and transparency mechanisms. That includes clearer disclosure of how projects are selected, how sustainability criteria are applied, and how community concerns are assessed and resolved. Without this, strategic designation risks being seen internationally as a supply-security shortcut rather than a sustainability standard.

Consent as infrastructure

The emerging consensus is that local consent is infrastructure, not an optional ESG layer. Alongside roads, ports, energy supply and processing facilities, projects also require public trust, governance transparency and benefit-sharing frameworks. Without these, permitting reform alone may accelerate conflict rather than investment.

A test of Europe’s resource strategy

Europe has built a sophisticated critical raw materials framework, with targets, funding tools, and strategic project lists. The next phase will determine whether it can match that speed with legitimacy on the ground.

The challenge is no longer only securing copper, lithium, nickel and rare earths, but ensuring that their development is socially stable, environmentally defensible, and politically sustainable in the regions where extraction actually happens. Without that balance, Europe’s critical minerals push risks becoming strategically ambitious—but practically constrained by the very communities it depends on.
